These terms govern the services offered by DM Broadband (OPC) Private Limited (“DM Broadband”, “we”, “us”), a company incorporated under the Companies Act, 2013 with CIN U93000GJ2022OPC128899, having its registered office at Shop No. 17, Ground Floor, Sadguru Complex, Unn, Surat, Gujarat – 394520, through the website dmbroadband.net and at our offices. By subscribing to a service, placing an order, or making a payment to us, you accept these terms.

1. Services we provide

• Fiber broadband (FTTH) for homes and shops within our GEPON coverage area.
• Air Fiber wireless connectivity for businesses and industrial sites.
• Leased lines, static IP and VPN solutions for business customers.

Services are provided under a Unified Licence (Virtual Network Operator), ISP Category B, for the Gujarat Service Area, granted by the Department of Telecommunications vide licence no. DS-11/165/2024-DS-III dated 15 April 2025. Services are available only where a technical feasibility survey succeeds.

2. Eligibility and KYC

• You must be at least 18 years old and legally able to enter into a contract.
• You must provide one photograph, one identity proof and one address proof before activation, as required under our licence conditions. Service can be refused or suspended if documents are not provided, or are found to be false.
• The connection is issued in the name of the subscriber whose documents are recorded. It must not be transferred, resold, sub-let or shared commercially without our written consent.

3. Tariffs, billing and taxes

• Plans are prepaid and billed in advance for the period you select. The service is active for the paid period only.
• Prices published on this website are exclusive of GST, which is charged additionally at the applicable rate. A GST invoice is issued under GSTIN 24AAJCD0392C1Z1.
• First-time installation and activation is charged at ₹1,000. A static IP address, where taken, is charged at ₹150 per month. Shifting a connection to a new address is charged at ₹1,500.
• Tariffs may be revised with prior intimation.
• If payment is not received by the due date, the connection may be suspended after a short grace period and reactivated once payment clears. Repeated non-payment may lead to termination and recovery of dues.

4. Equipment

• Equipment supplied on a rental or deposit basis (ONT, router, outdoor unit, cabling) remains our property unless it has been sold to you outright, and must be returned in working condition on termination.
• Loss, theft or damage caused by you, other than normal wear and tear, is recoverable at replacement cost.
• You are responsible for providing continuous electricity supply to the equipment installed at your premises.
• Do not open, modify or relocate the installed equipment yourself. Tampering voids warranty and may interrupt service.

5. Service quality and availability

• Speeds shown are the maximum achievable on the plan and are measured at the point of delivery. Actual speed depends on your device, Wi-Fi conditions, wiring and network conditions.
• Plans described as unlimited carry no daily data cap. Any fair usage measures are notified in advance.
• We aim for high uptime but cannot guarantee uninterrupted service. Planned maintenance is notified where practical. Air Fiber links can be affected by weather and by any obstruction of line of sight.
• Service can be interrupted by cable cuts, power failure, force majeure events, or by directions of a competent authority, and such interruption is not a breach of these terms.
• OTT applications and live TV channels bundled with a plan are supplied by third parties. Their content, availability and terms are set by those providers and may change.

6. Acceptable use

You agree not to use the connection to:

• break any law of India, or infringe anyone's intellectual property;
• send spam, run phishing or fraud, distribute malware, or attempt unauthorised access to any system;
• host or transmit obscene, defamatory, or unlawful material, including anything prohibited under the Information Technology Act, 2000 and the rules made under it;
• resell the bandwidth, operate a public hotspot or cyber cafe on a residential plan, or share the connection outside your premises;
• interfere with our network or with other subscribers' use of it.

Violation may lead to immediate suspension or termination without refund, and to reporting to the authorities where the law requires it.

7. Complaints

• Register complaints on +91 73839 68600 or +91 99049 68600, or at dmbroadband@gmail.com, and note the complaint number given to you.
• We attend to complaints within 8 working hours and aim to resolve them within 7 working days.
• If a complaint remains unresolved, write to the Director at dmbroadband@gmail.com quoting the complaint number.

8. Suspension and termination

• You may terminate by giving us written notice; charges for the notice period and any dues remain payable.
• We may suspend or terminate for non-payment, breach of these terms, misuse of the service, or on the direction of a licensor or competent authority.
• On termination you must clear all dues and return our equipment. Refunds, if any, follow our refund & cancellation policy.

9. Limitation of liability

Our liability for any claim arising out of the service is limited to the amount you paid us for the affected billing period. We are not liable for indirect or consequential loss, including loss of business, profits or data. Nothing in these terms limits liability that cannot be limited under Indian law.

10. Changes to these terms

We may update these terms and will publish the revised version on this page with a new date. Continuing to use the service after that means you accept the change.

11. Governing law

These terms are governed by the laws of India. Courts at Surat, Gujarat have jurisdiction, without prejudice to any remedy available to you under consumer protection law.
